Upon the breakdown of your marriage or civil partnership, sorting out financial issues can be particularly stressful especially deciding what happens to the former matrimonial home. We have a sensitive and sympathetic approach to the issues you are facing.
It can be a daunting exercise when considering all your financial assets. However we can assist you through the process.
In the first instance we will try to reach a financial settlement with the other side outside of court, as this is the most cost effective and amicable resolution. We would begin by ensuring full financial disclosure with the other side and requesting the same. Once a settlement is achieved between the parties then a is drafted according to the terms of the agreement. The draft consent order is then submitted to the court to be finalised. By having the settlement finalised at court it ensures that both parties are bound to the terms and do not break them at a later date.
In situations where it is not possible to reach an agreement, it may be appropriate to make an application to the Court and in such circumstances we will act in your best interests.
It is important that you contact us as soon as possible before making any decisions so that we can give you the best advice about the various options available to you. We can also advise you on financial arrangements for children.
